We would like to let you know that the Labor Department for Moscow together with the Interdepartmental Committee considers quota applications filed for the year 2012. Unfortunately many of such requests are being rejected due to a number of reasons, among them we could underline: ?possibility to fill the positions with local labor force, training of unemployed Russian nationals and employment of Russian nationals from other regions of the country?; or ?the fact the positions are considered quota-exempt for the year 2011?.
Companies ? Employers receiving the rejection will still have the opportunity to employ foreign nationals in the coming year, they are as follows:
- Applying for Highly-qualified specialist work permit (applicable to Russian legal entities and Branch offices of foreign legal entities, provide the salary of a foreign national exceeds 167 000 RUR / month);
- Use of quota-exempt position, the list should be approved in the beginning of the year 2012;
- Filing the quota correction application in the beginning of the year 2012 for the review of the Interdepartamental Committee.
We would also like to draw your attention to the prolonged delays with processing of Employment permits that currently are about 30 days. The situation is caused by technical problems of the Labor Department for Moscow (the Labor Department cannot prepare their Resolutions that should be forwarded to the Department of the Federal Migration Service for Moscow, and without such a Resolution the DFMS cannot issue the Employment permit and consequently process the work permit). Based on the internal information received from the Labor Department official and considering their current move to a new building, the situation is unlikely to change within the next month.
From our side we will try minimize the negative consequences because of the current situation, however, unfortunately, we cannot guarantee the positive outcome for each particular case. Therefore there is still a risk that foreign nationals whose work permit applications are being processed (at the stage of Employment permit issue) might have to leave the territory of the Russian Federation and wait for a new work permit / invitation letter to be issued.
