CHANGES IN RUSSIAN IMMIGRATION LEGISLATION

On July 19, 2006 President of the Russian Federation Vladimir Putin signed two Russian Federal Laws aimed at improving Russian immigration legislation and simplifying immigration procedures for expatriate nationals arriving in Russia, namely: Federal Law of the Russian Federation # 110-FZ dated July 18, 2006 ?On introduction of amendments to the Federal Law of the Russian Federation ?On legal status of expatriate nationals in the Russian Federation? and on voidance of individual provisions of the Federal Law of the Russian Federation ?On introduction of amendments to some legal acts of the Russian Federation? and Federal Law of the Russian Federation # 109-FZ dated July 18, 2006 ?On immigration record of expatriate nationals and stateless persons in the Russian Federation?. The Federal Law # 110-FZ aims at simplifying of existing immigration procedures and, in particular, it allows expatriate nationals arrived in the Russian Federation by way of visa-free regime (citizens of most CIS countries) to individually submit applications for Work Permit issue to appropriate Russian migration authorities and obtain Work Permits within 10 days from the day of application. Employers are entitled to employ such expatriate employees without preliminary receiving of Employment Permit. Besides, this Federal Law establishes a new simplified procedure of obtaining of Temporary Residence Permits by expatriate nationals as mentioned above. The Federal Law # 109-FZ aims at establishing a new mechanism for record of expatriate nationals and stateless persons which are permanently reside or temporary stay in the Russian Federation. In particular, it introduces simplified systems of registration at the place of residence and record at the place of stay in the Russian Federation for expatriate nationals and stateless persons. In addition this Federal Law establishes a notification procedure of record at the place of stay for expatriate nationals and stateless persons who are temporary stay in the Russian Federation. These Federal Laws will come into effect on January 15, 2007. The mechanism of enforcement of the above Federal Laws will be later developed and put in force by the Government of the Russian Federation.
