Hereby we bring to your notice the following important information.

On November 06, 2006 became effective the amendments to the Code of the Russian Federation of administrative violations (hereinafter referred to as the Administrative Code), introduced by the Federal Law of the Russian Federation dated 05.11.2006 No. 189-FZ. The indicated amendments are aimed at increase of liability for the breach of the migration legislation of the Russian Federation by the foreign and the Russian citizens, companies (legal entities) and their officials.

The amendments, among other things, related to the following essential issues and defined or increased the amounts of administrative liability arising due to the following breaches in the area of the migration legislation of the Russian Federation:

• illegal employment of the foreign citizens and persons without citizenship in the Russian Federation;
• illegal labor activity of the foreign citizen and person without citizenship in the Russian Federation;
• breach of immigration rules: rules of entry, of stay (living), departure from the Russian Federation of the foreign citizens and persons without citizenship;
• breach by company or person inviting the foreign citizens and persons without citizenship in the Russian Federation of the defined order of documents execution for their right of stay, living, movement, change of the place of location or living in the Russian Federation;
• breach of the migration registration rules regarding the foreign citizens and persons without citizenship;
• breach by the foreign citizen and person without citizenship of rules for entry into the Russian Federation or the rules of stay (living) in the Russian Federation, expressed in incompliance of the declared purpose of entry into the Russian Federation and the actual activity or type of business implemented during the stay (living) in the Russian Federation.

The formerly valid sizes of liability (administrative penalties) for such kind of breaches were significantly increased; in addition, the law maker has introduced the new types of liability. For certain breaches the lawmaker provides the possibility of administrative suspension for the period of up to 90 days in activity of the legal entities or persons performing the business activity without formation of the legal entity.

The main part of amendments becomes effective from 06.11.2006 (from the moment of official publication of the Federal Law of the Russian Federation dated 05.11.2006 No. 189-FZ), other amendments shall become effective from 15.01.2007.
